General terms and conditions

The general terms and conditions of the online store: rogaska.si are drawn up in accordance with the Consumer Protection Act (ZVPot), the Consumer Protection Act against Unfair Business Practices (ZVPNPP) and the Electronic Commerce Act (ZEPT) and international e-commerce codes. The online store: rogaska.si is an information system intended for the presentation and sale of products and services to the user. It is operated by Hotel Sava Rogaška d.o.o., hereinafter referred to as the provider. The user is the person who uses the system, i.e. the buyer in the online store. The general terms and conditions of the online store: rogaska.si, the rights of the user and the business relationship between the provider and the user/buyer. The contents accessible to users of this website are creations protected as copyrighted works in accordance with the provisions of the Copyright and Related Rights Act (Official Gazette of the Republic of Slovenia, 21/1995 as amended) and other applicable regulations. The owner of the copyright and any other rights to the aforementioned copyrighted works is Hotel Sava Rogaška d.o.o. Without express written permission, users of the website rogaska.si are not permitted to reproduce, distribute, transmit, broadcast, display or otherwise publicly communicate the copyrighted works contained on this website.

Prices

All prices of our products are clearly displayed, all prices of items include VAT. The provider reserves the right to change prices daily, unless otherwise stated. Prices listed on the website do not include shipping costs. Prices are valid at the time of placing the order and have no predetermined validity. Prices are valid in the case of payment by the specified payment methods, under the specified conditions. A discounted price is a reduced regular price that is valid for a fixed or indefinite period.

Products and Photos

All photos are for illustrative purposes only and do not guarantee the product’s properties. The color shades and appearance of the products may differ from the actual product, which does not affect the definition and standard of the product. The provider does not accept responsibility for any minor differences between the products and the display in the online store. Textual errors are possible and the provider does not assume responsibility for them, which does not affect the buyer’s legal rights.

Purchase process

The buyer selects the type and quantity of the product. Fill in the name, recipient’s email and message for the recipient. Before placing the order, review the shopping cart, make any corrections or continue with the purchase and confirm the order. A form will follow in which the buyer enters all the necessary information. After confirming the purchase, changes are no longer possible. After completing the purchase, the user will be notified via email about the purchase. If the user has chosen to pay by invoice, the payment information will be automatically sent to their email address. Orders are accepted every day.

Ordering gift vouchers

After receiving the payment, we will send an email to the recipient and you with a link to the electronic gift voucher. When paying to our account, you will receive a link to the gift voucher after the payment has been recorded. Gift vouchers are equipped with a unique code that is required to redeem the voucher. The customer is responsible for maintaining the confidentiality of the voucher template. Hotel Sava Rogaška d.o.o. is not responsible for misuse of the gift voucher template. Each gift voucher can only be redeemed once. The gift voucher is valid for one year from the stated date and cannot be exchanged for cash.

Payment methods

The buyer can make a payment:

by pro forma invoice (by transfer to our account, payment instructions will be sent when placing the order).
You settle the payment to our bank account. Enter the order ID as a reference. We ship the order when we receive the payment to our bank account.
by credit card

Refund

The buyer has the right to notify the provider within 14 days of receiving the gift voucher to the e-mail address: that he withdraws from the contract or order, without having to state the reason for his decision.
The gift voucher must not have already been redeemed.
We will refund the payments made to the buyer as soon as possible, but no later than 14 days after receiving the message about withdrawal from the contract. The company will return the payments received to the buyer with the same means of payment as the buyer used (which is most commonly by payment to a transaction account), unless the consumer has explicitly requested the use of a different means of payment and if the buyer does not bear any costs as a result.
In accordance with paragraph 5 of Article 43 of the Consumer Protection Act, the buyer does not have the right to withdraw from the contract (purchase) if it is a product manufactured according to the buyer’s precise instructions that was adapted to his personal needs.
The buyer may complain about the goods if the seller has sent the wrong products or in the wrong quantity. In this case, the buyer can notify the seller about the complaint at +386 3 811 40 00 or e-mail: , and request a replacement or refund.
The seller does his best to ensure that the information published on his website is up-to-date and correct. However, the characteristics of the goods or the price may change so quickly that the provider is unable to correct the information on the website. In such a case, the seller will inform the buyer about the changes and allow him to cancel the order or replace the ordered product. The seller is not responsible for the content of opinions about products written by visitors. The seller reviews the opinions before publishing and rejects those that contain obvious untruths, are misleading or offensive. The seller is not responsible for the information in the opinions and disclaims any liability arising from this. Although the seller makes every effort to provide accurate photographs of the items for sale, all photographs should be taken as symbolic. Photographs do not guarantee the characteristics of the product.

Complaints and disputes

The Seller complies with the applicable consumer protection legislation (ZVPot). The Seller makes every effort to fulfill its duty to establish an effective system for handling complaints. The Seller will confirm to the Buyer within five (5) working days that it has received the complaint, inform the Buyer of how long it will take to handle it and keep him informed about the progress of the procedure. The Seller is aware that the essential characteristic of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportionality between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle to the consumer not initiating a dispute before the court. Therefore, the Seller makes every effort to resolve any disputes amicably.
In accordance with legal regulations, Hotel Sava Rogaška d.o.o. does not recognize any provider of out-of-court consumer dispute resolution as competent for resolving a consumer dispute that a consumer could initiate in accordance with the Out-of-Court Resolution of Consumer Disputes Act.
Rogaska.si, which as a provider of goods and services enables online shopping in the Republic of Slovenia, publishes an electronic link to the online consumer dispute resolution platform (SRPS) on its website. The platform is available to consumers at the website address.

The aforementioned regulation arises from the Out-of-Court Resolution of Consumer Disputes Act, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on online consumer dispute resolution and amending Regulation (EC) No. 2016/2004 and Directive 2009/22/EC.
